Jamal v Moola Dawood, [1915] UKPC 51
Citation: Jamal v Moola Dawood, [1915] UKPC 51
Rule of thumb: What happens if the damages a person is claiming in a legal action seem grossly excessive? These may be excessive and may not have to be paid to the full extent. A person who suffers a breach of law being done to them must take reasonable measures to mitigate their losses.
Judgment:
A person who suffers a breach of law being done to them must take reasonable measures to mitigate their losses, ’It is an undoubted law that a plaintiff who sues for damages owes the duty of taking reasonable steps to mitigate the loss consequent upon the breach, and cannot claim as damages which is due to his own neglect. But, the loss to be ascertained is the loss at the date of breach”, Lord Wrenbury
