Rule of thumb:Does a Solicitor have a duty to tell his client all information he knows about an issue (including a potential opponent’s character & reputation), as well as provide legal advice? Yes, they do. This is part of the reason why a Solicitor cannot act with a conflict of interest.
Judgment:
This is the classic case to confirm that where a solicitor potentially has a conflict of interest in a case, then they should not act - ‘A solicitor is bound to put at his client’s disposal not only his skill but also his knowledge so far as was relevant; and if he is unwilling to reveal his knowledge to his client, he should not act for him. What he cannot do is act for the client and at the same time withhold from him any relevant knowledge he has’, Megarry J
