Froom v Butcher, 1975 All ER 520
Citation:Froom v Butcher, 1975 All ER 520
Rule of thumb:What happens if you were not wearing your seatbelt during a car accident – can you still get damages if you were injured? Yes, but it will be deemed contributory negligence and could reduce your damages by around 25%.
Judgment:
‘Sometimes the evidence will show that the failure made no difference. The damage would have been the same, even if a seatbelt had been worn. In such cases damages should not be reduced at all’, The Court of Appeal
