Hirani v Hirani (1982) 4 FLR 232, CA
Citation:Hirani v Hirani (1982) 4 FLR 232, CA
Rule of thumb:If you were forced into a marriage you did not want to enter, can it be reduced? If there were no illegal threats, it has to be shown that it was extreme emotional blackmail to be completely overborne, which is extremely hard to prove.
Judgment:
When someone looks to reduce a marriage because they claim they were forced into, the Court has to consider if the person’s will was overpowered and it differs for different people, ‘subjectively... Did the threats constitute undue pressure overbearing the person’s will?’ Court opinion
