Rule of thumb:Do the same laws & standards of procedure apply in all different types of cases? Yes and no. Yes in the sense it is the same principles, no, in the sense that the exact manner that they are applied varies massively from law subject to law subject, for example, criminal trials have a very different manner of practice than family hearings involving custody of children etc.
Judgment:
'In terms of the balance between the advocate’s duty to the client and the advocate’s duty to the Court must reflect evolutionary change within the civil justice system. If evolutionary shifts are necessary to match civil justice reforms they should be towards strengthening the duty to the Court. Differing practices and procedures in the family justice system, the criminal justice system, and civil justice system must be reflected in different requirement in, for instance, a criminal trial and a Children Hearing Act’, Thorpe LJ
