Rule of thumb:If a person disputes that they owe money to another person, but do not provide any reasonable explanation, what Court should this be raised in? This should be raised a debt action.

Judgment:

‘... it is not sufficient for the respondents, upon a petition of this kind, to say, “WE dispute the claim”. They must bring forward a prima facie case which satisfies the Court that there is something which ought to be tried’, Lord Jessel MR, at page 253
