Rule of thumb: Will divorcing spouses ever be expected to share property after a divorce? No – property must either go to one of the parties or be sold – it would be exceptionally rare for shared property to ever occur.
Judgment:
This case confirmed the famous ‘white leopard principle’ - that it is almost impossible that the parties to a divorce would be asked to share property afterwards. If the parties cannot decide who gets a form of property, it will have to be converted into cash, ‘An order to share a property after divorce... would be as rare as a white leopard’.
