Rule of thumb: If a shop sells combinations of items to a person which could be used for a criminal purpose, is this a crime? Yes, if people are buying combinations of items which could be used for a criminal purpose the shop themselves is committing a crime by selling them to the person.
Judgment:
The basic facts of this case were that a shopkeeper sold items to children who combined these to make drugs. The Court deemed that the shopkeeper was aware of this and that this was a criminal offence. ’There is ample authority for the view that the wilful and reckless administration of a dangerous substance to another causing injury or death is a crime at common law in Scotland’, Lord Emslie
