White v White 2001 SLT 485 (IH)
Citation: White v White 2001 SLT 485 (IH)
Rule of thumb: If a parent has been a terrible parent, can they be banned from seeing their child? The general rule is no, albeit there will be some exceptions.
Judgment:
This case affirmed the parental access principle – in almost all cases a parent will granted some form of access to see their children, and it will take an extremely compelling body of evidence against this to convince the Court otherwise, "it may normally be assumed that the child will benefit from continued contact with the natural parents."
