Rule of thumb: What is the fundamental test for professional misconduct which licensing bodies should apply? This whole area stems from whether the conduct is widely deemed to be disgraceful & dishonourable – if so then sanctions must be imposed upon the person to keep the standards within the licensed industry at a decent level.

Judgment:

This is known as the ‘disgraceful and dishonourable test’ in licensing disciplinary matters for considering when misconduct needs to be reprimanded, ‘if a practitioner in the pursuit of his profession has done something with regard to it which would reasonably be regarded as disgraceful or dishonourable by his professional brethren of good repute and competency, then it is open to the Disciplinary Committee to say that he had been guilty of professional misconduct’, LJ Lopes (licensing)
